These Terms & Conditions (“Terms”) govern your access to and use of the website and the products and services offered by Nguyen and Le Bakery (“we,” “us,” or “our”), which operates under the brand name Katered Kneads. By browsing our website, placing an order, or otherwise using our services, you agree to these Terms. If you do not agree, please do not use our website or place an order.

When you place an order, you are making an offer to purchase our products or services subject to these Terms. An order is only confirmed once we accept it and, where applicable, payment (or a required deposit) has been received. We reserve the right to refuse or cancel any order at our discretion, including where an item is unavailable, where there is an error in pricing or product information, or where we are unable to meet your requested date.
Advance orders. Our baked goods and catering are made to order and generally require advance notice. Required lead times are stated at the time of ordering or on the relevant product or service page. Please place your order with sufficient lead time, especially for custom and large-quantity orders.
Orders are fulfilled by local pickup at the location and during the pickup window we provide when your order is confirmed. Please arrive within your scheduled pickup window. Because our products are perishable, we cannot guarantee the quality or availability of items not collected during the scheduled window, and we are not responsible for the condition of products after they leave our care.
Requests to cancel or change an order are subject to our cancellation cutoff and lead-time requirements, which are provided when you order. Refunds are addressed in our separate Refund Policy, which forms part of these Terms. In short, because our products are made to order and perishable, refunds are provided in limited circumstances, such as where an order is incorrect, defective in quality, or not provided. Allergen notice. Our products are made in a kitchen that handles common allergens, including but not limited to wheat and gluten, eggs, dairy, peanuts, tree nuts, soy, and sesame. We cannot guarantee that any product is free from these or other allergens, and cross-contact may occur even where an item is described as free from a particular ingredient. If you or anyone you are ordering for has a food allergy or intolerance, please contact us before ordering, and order at your own discretion. You are responsible for informing your guests of potential allergens.
Our products are perishable and intended for prompt consumption. Once products are picked up, proper storage, handling, refrigeration, and timely consumption are your responsibility. We are not liable for issues arising from improper storage or handling after pickup.
For custom orders, we will do our best to match your requests, including designs, flavors, and decorations. Handmade items are subject to natural variation, and finished products may differ slightly from photographs, samples, or descriptions. Such variation is not a defect. You are responsible for ensuring that spellings, dates, and other details you provide are correct at the time of ordering.
All content on our website, including text, logos, photographs, graphics, and the Katered Kneads name and branding, is owned by or licensed to us and is protected by applicable intellectual property laws. You may not copy, reproduce, or use our content for commercial purposes without our prior written permission.
You agree to use our website and services only for lawful purposes and not to: provide false or misleading information; interfere with or disrupt the website; attempt to gain unauthorized access to our systems; or use our content or services in any way that infringes the rights of others.
To the fullest extent permitted by law, our website and products are provided “as is” and “as available,” and we disclaim all warranties not expressly stated in these Terms. We do not warrant that the website will be uninterrupted or error-free.
To the fullest extent permitted by law, our total liability to you for any claim arising out of or relating to your order or these Terms will not exceed the amount you paid for the order giving rise to the claim. We are not liable for indirect, incidental, or consequential damages. Nothing in these Terms limits any liability that cannot be limited under applicable law, including liability for personal injury caused by our negligence.
You agree to indemnify and hold harmless Nguyen and Le Bakery and its owners and employees from any claims, losses, or expenses arising out of your breach of these Terms or your misuse of our products or website, including any failure to inform your guests of potential allergens.
These Terms are governed by the laws of the State of California, without regard to its conflict-of-law rules. Subject to the dispute resolution section below, you agree that the state and federal courts located in California will have jurisdiction over any disputes.
Informal resolution first. If you have a concern, please contact us at kateredkneads@gmail.com so we can try to resolve it. We are committed to working with you in good faith, and most issues can be resolved quickly and informally. You agree to give us at least 30 days to resolve a dispute informally before starting any formal proceeding.
Small claims. Either of us may bring an individual claim in a small claims court located in California if the claim qualifies. Any other dispute that cannot be resolved informally will be handled by the courts identified in the Governing Law section. You and we agree that claims will be brought only in an individual capacity and not as part of a class action.
We may update these Terms from time to time. The version posted on our website with the most recent effective date applies to your use of the website and to new orders. Your continued use of the website or placement of new orders after changes are posted constitutes acceptance of the updated Terms.
